Creativetothekorh tries very hard to make sure that our platform is always up to date and available. However due to unforeseen circumstances there may be times where we cannot guarantee this. Rest assured, Creativetothekorh will work hard to get the website and its services back up and running as soon as possible. Creativetothekorh from time to time may modify, add or remove parts of the website where we see fit in order to give you a better customer services experience. If you object to anything in this agreement or the Creativetothekorh ‘Privacy & Cookie Policy‘, do not use the website or it’s service. To make it easier for you to understand we have provided a short summary of each section. Please note that these summaries are not official legal terms and advise that you fully read each part of our Terms & Conditions carefully.
Definitions & Interpretations
The following words shall have the followings meaning in these Terms & Conditions: ‘Agreement’ shall mean these Terms & Conditions. ‘The Company’ refers to Creativetothekorh. ‘Platform’ refers to the website, application, or service offered by Creativetothekorh. ‘ Vendor(s)’ refers to artists that sign up to our platform to sell their own self made products which can be listed/sold on their very own personal store portal. ‘Artists Product’s’ refers to the products listed by vendors which are displayed in and around the website, and/or social media networks, as well as for sale purposes. ‘Privacy Policy’ refers to the statement or policy that discloses some or all of the ways the company gathers, uses, discloses and managers artists data and artwork. ‘Service(s)’ refers to the entirety of the services available to you via the Creativetothekorh website. The term ‘us’, ‘we’, ‘our’ refers to all services owned and operated by Creativetothekorh, its website and or social media networks, and any organisation or person/’s using the website on or behalf of any organisations.
This Agreement
Creativetothekorh provides a service to allow artists to register, create, list and self manage/run their very own products via their very own online store portal.
Creativetothekorh from time to time may modify this agreement. When we do we will update and publish the latest version. If we feel that you are in breach, or not abiding by our terms and conditions, we have the right to suspend or remove your products/services with no refunds given.
Eligibility
By using the Creativetothekorh website you are confirming that you have read all of our terms and conditions and abide and agree to our terms of service. You should not have been convicted of any offence, or be subject to any court order relating to assault, violence, sexual misconduct or harassment. Any breach of this clause constitutes a serious breach of this agreement. Creativetothekorh does not currently undertake a criminal background check on our artists. You are therefore completely responsible in taking the necessary safety precautions when using this site or service.
Vendors Duties
Artists and or person/’s are 100% responsible for the ‘Products’ that they provide, which means any information, or products submitted to us must be of the artists and or person/’s own making and not taken from any other sources without written consent. The products that artists and or person/’s provide must comply with our ‘Terms & Conditions’.
A vendor’s duties when signing up to our services must convey themselves in a professional manner when interacting with anyone using the website. Vendor’s acts as an extension of us and the website ‘Creativetothekorh’ and must act in a professional manner. Failure to do so may have your access revoked and removed from the website with no refunds given.
When listing a product for sale a vendor must first make sure that the images are clear and the product information is easy to read and understand. If we feel this does not meet our requirements we will contact you to review and amend. Failure to do this may result in your listing not being approved and or removed from the Creativetothekorh website.
Vendor’s must give clear information on each product listing page and or personal online store portal of their ‘Refund & Returns Policy’ and product ‘Shipping’ information. If this information is missing we advise customers to contact the vendor artist in question to confirm their policies prior purchasing any products.
Once a vendor sells a product and completes on payment and shipping of their sold items, it is the vendors duty to request their funds to us via their vendor dashboards. Once we receive this request we will process as soon as possible. Please note that we charge a small percentage admin fee of each item sold in order to maintain and grow the platform.
All Vendor’s on the Creativetothekorh website are personally responsible for declaring their outgoings/earnings to the correct government authorities for tax calculation purposes.
Anyone interested in becoming a ‘Vendor’ must be 18 years of age, meet the requirements to the concerned services, be legally able to contract, not be under guardianship or curatorship, have read and accepted these ‘Terms & Conditions’ and ‘Privacy & Cookie Policy’ page.
Please note that our team make their best efforts in detecting content which may be inappropriate and violates our ‘Terms & Conditions’. If you notice or have proof that any products/artworks/Images listed on our platform has been copied from another source and not of the artists/business owners and or person/’s original creation without written consent then please contact us via our ‘Contact’ page.
Store Products & Payments
Each vendor will have the ability to create, list and sell their very own products within their very own (self managed) online store portal. All products listed by vendor will be reviewed by a member of our team before being approved and publicly listed on the Creativetothekorh website. All products listed by a vendor must be of the actual product and or best representation of the product, with accurate product detail information when listing for sale.
Please note that listed products and their colours may vary when viewing from our website due to different device settings used when viewing our products, i.e. screen brightness, resolution, sizing etc.
Customers/Vendors using a card payment to purchase/sell a product through the Creativetothekorh online store, must be the authorised account holder of the card and/or have permission and fund’s to make the relevant payment. All payments made through the Creativetothekorh website is through ‘PayPal’, ‘Debit Card’ and or ‘Google Pay’. Our payment systems allows our users to check out faster, safer and easier. Please note that all Debit Card payments made to us has a pending period of ‘7 Days’ before these funds are cleared and received. For those that wish to pay via PayPal, it is free to sign up to and takes less then five minutes. Please note that PayPal have their own ‘Terms & Conditions’ to comply with before using.
For vendors requesting funds of their sold items, each item must be fully completed (sold/delivered) in order for us to process this request and meet our withdrawal limit. Once we receive confirmation we will transfer your funds to you as soon as possible minus our small percentage admin fee.
Vendor Subscriptions
Vendors that wish to reduce our small chargeable commission fee as well as gain vendor product support on their store listed items can do so by signing up to one of our subscription packages via our ‘Price Plan‘ page. Once subscribed you will be able to cancel, change payment or renew your subscription at any time. You will also have the option to set ‘Auto Renew’ as on for easier recurring payments.
Please note that no refunds will be provided if a subscription is cancelled.
Shipping
All vendor’s are to provide shipping details on each product that they list. Vendor’s can do this by adding this information to their ‘Description’ and or ‘Additional Information’ tab when listing an item. If a customer find this to be unclear, we advise you to contact the vendor directly to confirm shipping prior purchasing a product from them.
All items must be well packaged and checked by the vendor before sending to a customer.
Returns
All vendor’s are to provide a refund & returns policy on each product that they list. Vendor’s can do this by adding this information to their ‘Description’ and or ‘Additional Information’ tab when listing an item. If a customer find this to be unclear, we advise you to contact the vendor directly to confirm shipping prior purchasing a product from them.
Discounts Codes
Discount codes will only be available to use for products when items are set at their original sale price and not in conjunction with any other discounts. This applies to both physical and digital items sold on the Creativetothekorh website.
Creativetothekorh Duties & Responsibilities
We reserve the right to reject those who may come across racially, abusive, offensive, sexually orientated, threatening or even harassing when collaborating with the Creativetothekorh’s staff and/or services. No refunds will be given.
We hold the right to modify the services and/or listed artworks/products/listings of the Creativetothekorh site at anytime without notice.
You acknowledge and agree that Creativetothekorh may disclose information provided by you where required to by law at the request of a third party.
Creativetothekorh also reserve the right to disclose such information where we, in our sole discretion, believe the disclosure is reasonable to comply with the law, to fulfil request or orders from law enforcement or any other legal process. Any Information shall also be given in the event to protect or defend Creativetothekorh’s reputation or a third parties rights. Information may also be disclosed in order to protect someone’s health, safety or life, including the user, is being threatened by any harm or violence against any person.
Limitation Of Liability
Creativetothekorh, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this website, or social media platforms.
Creativetothekorh shall not be held liable for any losses or damages of corruption of data or programs or social media platforms/apps or service interruptions even where Creativetothekorh has been made aware of the possibility of such damages.
Creativetothekorh shall not be held liable for any losses or damages of falsified information provided by a subscribing vendor. If falsified information is found to be true then the vendor will take full responsibility in its entirety.
Creativetothekorh shall not be held liable for any losses or damages of any subscribing vendor imitating another person/’s or any other dishonest activity. If imitating another person/’s is found to be true then the vendor will take full responsibility in its entirety.
Creativetothekorh shall not be held liable for any losses or damages of any listings where information has been falsely submitted describing a product other. If a vendor’s listing has found to be falsely submitted describing a product then the vendor will take full responsibility in its entirety.
Creativetothekorh shall not be held liable for any losses or damages of any products, artworks, files or images that may have been plagiarized by a vendor. All products, artworks, files or images listed by a vendor must be of the artists own making and not taken from any other source without written consent.
Creativetothekorh shall not be held liable for any losses or damages of any artworks, files or images taken and used by a third party source from the Creativetothekorh website and or social media platforms.
Creativetothekorh shall not be held liable for any losses or damages of any products sent by vendor’s through the post and received by the customer. All products sold by a vendor must be packaged well and checked prior sending to a customer.
Creativetothekorh shall not be held liable for any vendors responsibility to declare their outgoings/earnings to the correct government bodies for tax purposes on the Creativetothekorh website.
Creativetothekorh shall not be held liable for any losses of any online payment details made within the Creativetothekorh website. Although we seek to protect online payment details in accordance with the payment card industry, data security standard, the security of such information transmitted via the internet cannot be guaranteed. As such any data transferred via the internet is at your own risk.
Creativetothekorh shall not be held responsible for any loss or damage resulting from anyone’s reliance on information on our service, or transmitted to our customers/users. This also includes any claims for losses or damages arising from the conduct of any customers/users who use the Creativetothekorh website.
It is possible that other customers or users (including unauthorized users, or ‘hackers’) may post or transmit offensive or obscene materials on the site which you may be involuntarily exposed to such offensive and obscene materials. We are not responsible for the use of any personal information which you may choose to disclose, or as a result of using, our services. Please carefully select the type of information which you post on the site or release to other users/customers.
No refunds will be given where a user is unable to access the website or services due to technical problems beyond our control.
Indemnity
You hereby indemnify to the fullest extent Creativetothekorh, including staff workers, owners, agents or affiliated companies from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these terms.
No Warranties
This website is provided ‘as is,’ with all faults, and Creativetothekorh express no representations or warranties, of any kind related to this website or the materials contained on this website. Also, nothing contained on this website shall be interpreted as advising you.

We ensure that we uphold a strict standard with regards to protection of privacy and how personal information is stored. Please view our ‘Privacy Policy’ on how the information you provide to us is stored.
Intellectual Property
All brand names, products, images, trademarks, copyrights and designs that Creativetothekorh create or are submitted and listed on the Creativetothekorh website belong to Creativetothekorh. No permission is granted or given to any user, customer or any entity in using this intellectual property.
Force Majeure
We accept no liability in the event that the website or services are either temporarily to permanently unavailable arising from matters out of our control, even though we may use all reasonable endeavours to reduce the possibility of this happening; there still remains no liability upon Creativetothekorh to reimburse or indemnify any persons under these ‘Terms and Conditions’.
Availability & Warranty
We shall perform our services with reasonable care and skill however we do not, under these terms and conditions, guarantee that services shall work and function without any interruption or error. There may be times that the website becomes unavailable due to maintenance, updates or technical improvements. Where possible, our members/users shall be informed of impending updates or maintenance. In order to use the service or website the user(s) must have the appropriate hardware and software in order to use the website properly. It is the user(s) and or any person(s) responsibility to ensure that they have the correct data package in order to allow them to access the services or website. Any costs relating thereto shall be the responsibility of the user or person, entity using the website. Any problems resulting due to the internet provider must be dealt with directly with the vendor or person data providing company. We shall not be responsible for any loses or damage arising or incurred by any third party which may lead to any error or defect in any software equipment or associated documentation, which is out of our control. We offer no warranty for any services or affiliates content which we receive by any third party, be it directly or indirectly.
Third Party Rights & Links
Nothing in this agreement is made for the benefit of the parties, and is not intended to benefit any third party or be enforceable by any third party. The rights of the parties to terminate, rescind, or agree any amendment, waiver, variation or settlement under or relating to this agreement is not subject to the consent of any third party. From time to time the website may have links to third party sites. By using these third companies, any agreement which is made between the vendor or person and the third parties are bound to the third party terms and conditions. These third party companies are by no way part or associated with Creativetothekorh and under no circumstances would be liable for any losses or damages caused by the third party. Should you accept any services from the third party then all communication should be between you and the third party. You agree that you are solely responsible for checking and evaluating the third party site and any services or products they may offer.
Assignment
Creativetothekorh is allowed to assign, transfer, and subcontract its rights and/or obligations under these terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these terms.
Waiver
No breach of any provision of this agreement will be waived except with the express written consent of the party not in breach.
Severance
If a clause of this agreement is determined by any court or other competent authority to be unlawful and/or unenforceable, the other clauses of this agreement will continue in effect.
Variation of Terms
Creativetothekorh is permitted to revise these terms at any time as it sees fit, and by using this website you are expected to review these terms on a regular basis.
Entire Agreement
These terms constitute the entire agreement between Creativetothekorh and you in relation to your collaboration and use of this website, and supersede all prior agreements and understandings.
Governing Law & Jurisdiction
This agreement shall be governed by and construed in accordance with English law and shall only be decided by English courts.
